ATA/339/1997 ΓÇó Determination of earning incapacity after accident
ATA/339/1997Cour de justice / Verwaltungskammer03.06.1997Confirmed
The cantonal court accepted the judicial expert report and held that the insured person's earning incapacity after the accident amounted to 67%, situated between the CNA's 35% estimate and the AI's 100% estimate. It also found that the CNA's economic survey was rather summary because only one company had been contacted, but the resulting salary ceiling of CHF 3,000 per month nevertheless lay within a realistic range for a comparable hypothetical activity.
LAA art. 18 al. 2; determination of earning incapacity and hypothetical salary after an accident; the court may rely on judicial expertise when it is convincing and places the assessment between divergent administrative evaluations. An economic investigation is not deprived of probative value merely because it is limited in scope; its results remain usable if, despite methodological shortcomings, the indicated salary lies within a realistic range of possibilities for a comparable activity (consid. unspecified).
