The dispute concerned the tariff applicable to osteodensitometry while the cantonal executive had not yet fixed an amount in the framework tariff. The court held that, in the interim, a tariff of CHF 391.40 had to be recognized. The decision therefore grants recognition of that tariff pending the executive authority's determination.
LAMAL art. 12; tariff applicable to osteodensitometry pending fixation by the cantonal executive authority; where the competent authority has not yet set the amount in the framework tariff, a provisional tariff may be recognized to permit billing of the service until a definitive tariff is established.
