Le TA a constaté que le licenciement de la VG respecte les exigences formelles et est justifié au fond (mauvaises appréciations de travail au cours du temps d'essai). Les statuts du personnel de l'administration de la Ville de Genève prévoient que le Conseil administratif peut librement résilier l'engagement d'un fonctionnaire à l'essai. Le Tribunal administratif doit donc faire preuve d'une extrême réserve quant au contrôle de l'excès du pouvoir d'appréciation, mais conserve un plein pouvoir d'examen quant à la validité formelle du licenciement.
