Kernrechtsfrage
Whether unfavorably terminated employees remained entitled to transition benefits after employment and pension coverage ended.
Extrahierter Entscheid
Unfurloughably dismissed employees kept the right to all transition benefits falling due after termination during the transition period; the later reglementary annex could not retroactively cut off that right.
Extrahierte Begründung
The pension relationship ended with the employment. The later annex was adopted only after termination and could not retroactively alter an already extinguished relationship. A gap in the original regulation had to be filled consistently with the principles governing distribution of free pension assets, especially equal treatment and protection of involuntarily departing insured persons.
