Omnilex-Zusammenfassung

The claimant appealed a cantonal social insurance judgment to the Federal Supreme Court. The appeal was filed, but the court held that it did not meet the statutory requirements of reasoning because it did not specifically explain why the cantonal findings were manifestly wrong or legally incorrect. In the simplified procedure, the court therefore did not enter into the appeal. Owing to the circumstances, it waived court costs.

Omnilex-Regeste

Art. 42 Abs. 1 und 2 BGG; Art. 97 Abs. 1 BGG; Art. 108 Abs. 1 lit. b BGG; non-entry for insufficient substantiation of an appeal. An appeal to the Federal Supreme Court must, in a case-specific and reasoned manner, indicate which points of the challenged decision are attacked and why the decision violates federal law. Mere assertions or abstract criticism do not satisfy the requirement that the reasons be directed to the contested reasoning. Where the submission fails to show, with reference to the facts and findings below, why the factual determination is manifestly incorrect or the legal assessment erroneous, the court may decline to enter under the simplified procedure (consid. 1). Under Art. 66 Abs. 1 sentence 2 BGG, costs may exceptionally be waived in view of the circumstances.

Beschwerde gegen den Entscheid des Sozialversicherungsgerichts des Kantons Zürich
vom 8. April 2009.

April 2009,

in Erwägung,

Kernrechtsfrage

Whether the appeal satisfied the formal reasoning requirements under the Federal Supreme Court Act.

Extrahierter Entscheid

The appeal did not sufficiently explain, in a case-specific manner, why the cantonal findings of fact were manifestly incorrect or why the challenged reasoning was legally erroneous.

Extrahierte Begründung

Under Art. 42 para. 1 and 2 BGG, an appeal must contain requests and reasons showing in a concise manner how the decision violates the law. Because the submission lacked such targeted arguments, it failed the minimum substantiation requirements.

Kernrechtsfrage

Whether court costs should be charged despite the non-entry decision.

Extrahierter Entscheid

Court costs were exceptionally waived.

Extrahierte Begründung

Applying Art. 66 para. 1 sentence 2 BGG, the court dispensed with costs due to the circumstances.
