Omnilex-Zusammenfassung

The Federal Supreme Court held that the appellant's submission in a social insurance case did not satisfy the statutory requirements of reasoning. The appeal merely repeated an appellatory critique of the Ticino Social Insurance Court's assessment of residual work capacity, without showing manifest factual error or a legal violation. The court therefore issued a simplified non-entry order and waived court costs.

Omnilex-Regeste

Art. 42 cpv. 1-2 LTF, art. 97 cpv. 1 LTF, art. 108 cpv. 1 lett. b LTF; requirements for appeal reasoning and limited review of facts. An appeal is inadmissible when it fails to engage with the decisive considerations of the challenged judgment and does not explain, in a substantiated manner, why the factual findings are manifestly inaccurate or unlawful and outcome-determinative. Questions of health impairment, work capacity and reasonable employability are factual determinations subject to only restricted Federal Supreme Court review. Mere appellatory criticism or repetition of one's own view is insufficient for admissibility. Where the appeal is manifestly unsubstantiated, the court may decide in simplified procedure and waive court costs under art. 66 cpv. 1 LTF.

Sentenza del 2 luglio 2012
II Corte di diritto sociale

Composizione
Giudice federale U. Meyer, Presidente,
cancelliere Grisanti.

Partecipanti al procedimento
E.________, Italia, patrocinato dalla Federazione Utenti Sanità Pubblica UCM,
ricorrente,

contro

Helsana Assicurazioni SA,

opponente.

Oggetto

Kernrechtsfrage

Whether the appeal met the formal reasoning requirements under the Federal Supreme Court Act

Extrahierter Entscheid

No. The appeal did not explain, in a legally sufficient way, why the lower court's findings were manifestly incorrect or unlawful.

Extrahierte Begründung

Under Art. 42 paras. 1 and 2 LTF, an appeal must set out requests and reasons and explain concisely why the challenged decision violates the law. The appellant merely repeated an appellatory disagreement and did not show any manifestly incorrect finding under Art. 97 para. 1 LTF.

Kernrechtsfrage

Whether the challenged factual findings on health damage, work capacity, and employability could be reviewed

Extrahierter Entscheid

Only within narrow limits, because these are factual questions reviewable by the Federal Supreme Court only for manifest inaccuracy or legal error affecting the outcome.

Extrahierte Begründung

The court reiterated that assessment of health damage, work capacity, and the reasonableness of professional activity is a question of fact subject to limited review.
