Omnilex-Zusammenfassung

R. sent writings to the Federal Tribunal concerning unemployment insurance, but did not attach the cantonal judgment and later said she did not wish to contest that judgment. The single judge held that the filing did not satisfy the formal requirements for a federal appeal and therefore did not enter into the matter. Because the first filing had been transmitted by the cantonal authority, the court exceptionally waived judicial fees.

Omnilex-Regeste

Art. 42 LTF; admissibility of a federal appeal; requirement to enclose the challenged decision and to state conclusions and reasons. The appeal must identify the object of the challenge by attaching the appealed decision; if the omission is not cured within the time limit set by the Federal Tribunal, the filing is not considered. A writing that expressly disclaims any intent to contest the impugned judgment confirms the absence of a proper appeal. If the deficient filing was forwarded by the cantonal authority, judicial fees may exceptionally be waived under Art. 66(1) LTF.

Arrêt du 21 avril 2009
Ire Cour de droit social

Composition

que dans une lettre adressée au Tribunal cantonal du Valais le 6 mars 2009, R.________ a formulé un certain nombre de remarques sur un jugement rendu par ce tribunal le 24 février 2008 [recte : le 24 février 2009];
que cette lettre a été transmise au Tribunal fédéral comme objet de sa compétence;
que le 12 mars 2009, le Président de la Ire Cour de droit social du Tribunal fédéral a invité la recourante à produire un exemplaire du jugement entrepris jusqu'au 23 mars 2009, en l'avertissant qu'à défaut, le mémoire ne sera pas pris en considération;
qu'il lui a également rappelé les conditions de recevabilité d'un recours en matière de droit public en la rendant attentive au fait que son écriture ne satisfaisait apparemment pas aux exigences requises;
que le 30 mars 2009, R.________ a envoyé une nouvelle écriture;
qu'en vertu de l'art. 42 al. 3 LTF, la décision attaquée doit être jointe au mémoire de recours;
que si cette annexe fait défaut, le Tribunal fédéral impartit un délai approprié à la partie pour remédier à l'irrégularité et l'avertit qu'à défaut, le mémoire ne sera pas pris en considération (art. 42 al. 5 LTF);
que par ailleurs, les mémoires doivent indiquer les conclusions, les motifs et les moyens de preuve (art. 42 al. 1 LTF);
que les motifs doivent exposer succinctement en quoi l'acte attaqué viole le droit (art. 42 al. 2, première phrase LTF);
que dans son écriture du 30 mars 2009, la recourante déclare qu'elle n'entend pas mettre en discussion le jugement cantonal du 24 février 2009, malgré les critiques qu'elle émet à son endroit ("[...] je ne veux pas contester le jugement du 24 février 2009 du Tribunal de Sion [...]");

qu'en tout état de cause, si ses écritures devaient être considérées comme un recours, celui-ci devrait être déclaré irrecevable;
qu'en effet, la recourante n'a pas produit le jugement attaqué;

Kernrechtsfrage

Whether the writings of 6 and 30 March 2009 met the admissibility requirements of a federal appeal.

Extrahierter Entscheid

They could not be entered into because the challenged decision was not produced and the later writing expressly disclaimed any intent to challenge the cantonal judgment.

Extrahierte Begründung

Under Art. 42 LTF, the appeal must include the attacked decision and state conclusions and reasons; the appellant failed to cure the defect and the writing of 30 March 2009 indicated no real intent to appeal.

Kernrechtsfrage

Whether court fees should be charged despite non-entry.

Extrahierter Entscheid

No judicial fees were levied exceptionally because the first writing had been transmitted to the Federal Tribunal by the cantonal authority.

Extrahierte Begründung

The court applied the exception in Art. 66(1) LTF and waived fees.
