Art. 49 CP applies only where the offences attract the same kind of penalty. Since simple traffic-rule violations and failure to comply with accident duties are punishable by a fine, while drunken driving and resistance to sobriety measures are punishable by pecuniary penalty or imprisonment, the sentencing court had to cumulate the sanctions.
