Whether the prosecution of the charged acts was time-barred under the applicable limitation rules
Extrahierter Entscheid
The old limitation regime applied as the more lenient law; under that regime the limitation period continued to run after the Federal Court remand, so acts committed up to 1995-07-27 were time-barred.
Extrahierte Begründung
For pre-2002 offences, lex mitior governs limitation. Under the old law, limitation stopped only with a final, enforceable cantonal conviction; after the Federal Court quashed that judgment and remanded, the period ran on. By the time of the new cantonal decision, older acts had become time-barred.
