Omnilex-Zusammenfassung

X. appealed to the Federal Tribunal against a Lausanne district court pronouncement that had held his appeal against a police-court sentence manifestly late. The Federal Tribunal found that the submission did not satisfy the reasoning requirements of the Federal Supreme Court Act: the appellant did not show timely filing and did not substantiate any violation of federal or constitutional law, including his complaint that he had not been summoned to a hearing. The appeal was therefore inadmissible. Costs of CHF 800 were imposed on the appellant.

Omnilex-Regeste

Art. 42 al. 1 et 2, art. 95, art. 106 al. 2 et art. 108 al. 1 let. b LTF; admissibility of a federal appeal and requirement of substantiated reasoning. A recourse is inadmissible where the appellant fails to indicate, in a concise but specific manner, how the challenged decision violates federal law or a precisely invoked constitutional right. If the decision rests on untimeliness, the appellant must in particular address that ground; merely asserting procedural defects without showing arbitrariness in the application of relevant cantonal law does not satisfy the pleading burden. The Federal Tribunal does not enter into inadequately reasoned grievances (consid. 1).

Arrêt du 3 septembre 2009

Parties
X.________,
recourant,

contre

Ministère public du canton de Vaud, 1014 Lausanne,
intimé.

Objet

Faits:

A.

Kernrechtsfrage

Whether the federal appeal was sufficiently reasoned to be admissible.

Extrahierter Entscheid

No. The appellant did not show that he had appealed within the legal time limit and did not set out, with the required precision, any violation of federal law or constitutional rights.

Extrahierte Begründung

Under Art. 42 and 106 LTF, an appellant must explain concretely how the challenged decision violates federal law or a specifically invoked constitutional right. The submission failed to address the timeliness ground and did not substantiate arbitrariness or a formal denial of justice.

Kernrechtsfrage

Allocation of federal court costs.

Extrahierter Entscheid

The appellant must bear the costs, reduced to CHF 800 because the judgment was rendered by a single judge.

Extrahierte Begründung

The losing party bears costs under Art. 66(1) LTF; in single-judge procedure the costs are ordinarily reduced.
