Omnilex-Zusammenfassung

The Federal Supreme Court dismissed a criminal appeal as inadmissible because the appellant failed to meet the federal reasoning requirements. He had been convicted by the Lausanne police court for a simple traffic-rule violation and his appeal had already been rejected by the Vaud cantonal appeal court. Before the Federal Supreme Court he mainly raised political criticisms of motorists and exhaust fumes, but did not engage with the cantonal court’s reasoning on recusal or on the rejection of a necessity defense. The appellant was ordered to pay CHF 800 in court costs.

Omnilex-Regeste

Art. 42 al. 1 et 2 LTF; art. 108 al. 1 let. b LTF; an appeal to the Federal Supreme Court is admissible only if it specifically and succinctly indicates how the challenged decision violates law. Mere political or abstract criticism, unconnected to the impugned reasoning, does not satisfy the duty to state reasons. The appellant must address the decisive cantonal grounds; failing this, the court does not enter into the merits. A necessity argument under Art. 17 CP must likewise be argued against the cantonal assessment, otherwise the submission remains unreviewed (consid. 2). Costs follow the outcome under Art. 66 al. 1 LTF.

X.________,
recourant,

contre

Kernrechtsfrage

Whether the criminal appeal satisfied the Federal Supreme Court’s reasoning requirements under Art. 42 LTF.

Extrahierter Entscheid

No. The appeal did not address the cantonal court’s reasoning in a legally relevant way and therefore was inadmissible.

Extrahierte Begründung

The appellant mainly advanced political arguments and failed to show, with specific legal reasoning, why the cantonal findings on recusal and on the conviction were unlawful. Under Art. 42 paras. 1-2 LTF, a federal appeal must briefly explain how the challenged decision violates the law; otherwise, inadmissibility follows under Art. 108 para. 1 lit. b LTF.

Kernrechtsfrage

Whether the cantonal court’s rejection of a necessity defense based on air pollution was unlawful.

Extrahierter Entscheid

The court did not examine the merits because the appellant failed to challenge the cantonal reasoning in a legally sufficient manner.

Extrahierte Begründung

The appellant did not explain why the view that exhaust fumes do not create a licit state of necessity under Art. 17 CP would violate federal law.

Kernrechtsfrage

Allocation of federal court costs.

Extrahierter Entscheid

Costs were charged to the unsuccessful appellant.

Extrahierte Begründung

As the appellant failed, he had to bear the judicial costs under Art. 66 para. 1 LTF.
