Omnilex-Zusammenfassung

X.________ AG challenged a cantonal appellate decision that had overturned a prosecutor’s non-entry order and directed the opening of a criminal investigation for receiving stolen goods. The Federal Court held that the challenged ruling did not end the cantonal proceedings and that no admissible ground for an immediate appeal under Art. 93(1) BGG was shown. It therefore did not enter into the complaint and ordered the company to pay CHF 800 in court costs. No compensation was awarded to A.________.

Omnilex-Regeste

Art. 90 and Art. 93 Abs. 1 BGG; appealability of cantonal decisions in criminal matters. A decision that merely annuls a non-entry order and instructs the prosecutor to open an investigation is an interlocutory decision that does not finally terminate the cantonal proceedings. Such a decision is directly challengeable only if the appellant demonstrates a statutory exception under Art. 93 Abs. 1 BGG; absent such showing, the Federal Court does not enter into the appeal pursuant to Art. 108 BGG. Where the appeal is not entered into, costs are borne by the appellant under Art. 66 Abs. 1 BGG; no party compensation is due if the respondent incurred no compensable effort.

Urteil vom 29. Juni 2009
Strafrechtliche Abteilung

Besetzung
Bundesrichter Favre, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________ AG,
Beschwerdeführerin,

gegen

A.________, vertreten durch Rechtsanwalt Peter A. Iten,
Beschwerdegegner,
Staatsanwaltschaft des Kantons Zug, 6301 Zug ,
Beschwerdegegnerin.

Gegenstand
Aufhebung einer Nichtanhandnahmeverfügung,

Beschwerde gegen das Urteil des Obergerichts des Kantons Zug, Justizkommission, Strafrechtliche Kammer, vom 27. Mai 2009.

Der Präsident zieht in Erwägung:

1.

3.
Dieses Urteil wird den Parteien und dem Obergericht des Kantons Zug, Justizkommission, Strafrechtliche Kammer, schriftlich mitgeteilt.

Kernrechtsfrage

Whether the appeal to the Federal Court was admissible against the cantonal decision ordering the prosecutor to open an investigation.

Extrahierter Entscheid

The appeal was inadmissible because the cantonal decision did not finally conclude the proceedings, and no exception under Art. 93(1) BGG was invoked or apparent.

Extrahierte Begründung

Only decisions terminating the cantonal proceedings are directly appealable under Art. 90 BGG. The challenged decision merely reopened the criminal investigation stage. The appellant did not rely on any exception under Art. 93(1) BGG.

Kernrechtsfrage

Allocation of court costs in the Federal Court proceedings.

Extrahierter Entscheid

Court costs were imposed on the appellant; no compensation was awarded to the respondent.

Extrahierte Begründung

As the appeal was not entered into, the appellant bore the costs. The respondent incurred no compensable expense before the Federal Court.
