Omnilex-Zusammenfassung

The Federal Supreme Court dismissed the criminal appeal as inadmissible. The appellant challenged a cantonal non-entry decision regarding an allegation of child abduction, relying on standing under Art. 81 Abs. 1 lit. b Ziff. 6 BGG. The Court held that this standing provision applies only to questions of the criminal complaint right itself. Because the appellant argued only substantive violations of Art. 220 StGB, Art. 8 ECHR, and the UN Convention on the Rights of the Child, and did not claim any violation of Arts. 30-33 StGB, he lacked standing. Court costs of CHF 800 were imposed on him.

Omnilex-Regeste

Art. 81 Abs. 1 lit. b Ziff. 6 BGG; standing in criminal matters to challenge a non-entry decision concerning a complaint-dependent offence. The legitimating effect of this provision is confined to issues relating to the criminal complaint right as such, i.e. the prerequisites and scope of Arts. 30-33 StGB. A complainant who merely invokes the substantive offence, constitutional guarantees, or the ECHR without alleging a violation of the complaint-right provisions lacks standing to appeal. In such a case, the Federal Supreme Court shall not enter into the appeal under Art. 108 BGG; costs are borne by the appellant pursuant to Art. 66 Abs. 1 BGG.

Urteil vom 2. Juli 2008
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer, vertreten durch Rechtsanwalt Dr. Simon Käch,

gegen

Y.________,
Beschwerdegegnerin.

Gegenstand

Kernrechtsfrage

Whether the appellant had standing under Art. 81 Abs. 1 lit. b Ziff. 6 BGG to challenge the non-entry decision.

Extrahierter Entscheid

Standing existed only insofar as the complaint concerned the criminal complaint right itself; because the appellant challenged only the substantive offence and related fundamental-rights issues, without alleging a violation of Arts. 30-33 StGB, he lacked standing.

Extrahierte Begründung

Art. 81 Abs. 1 lit. b Ziff. 6 BGG is limited to questions of the criminal complaint right as such. No other basis for standing was apparent, so the appeal could not be heard.

Kernrechtsfrage

Costs of the federal proceedings

Extrahierter Entscheid

Court costs were imposed on the appellant.

Extrahierte Begründung

As the appeal was inadmissible, the appellant bore the court costs under Art. 66 Abs. 1 BGG.
