Omnilex-Zusammenfassung

The Swiss Federal Court did not enter into the criminal complaint because the appellant challenged only the merits and failed to address the Higher Court's formal ground for non-entry, namely insufficient substantiation of the cantonal complaint. The Court held that the filing did not satisfy the requirements of Art. 42(2) BGG and therefore could not be reviewed under Art. 108 BGG. Court costs of CHF 800 were charged to the appellant.

Omnilex-Regeste

Art. 42 Abs. 2 BGG; Art. 108 BGG; non-entry for insufficient substantiation of the federal complaint. The Federal Supreme Court examines only the grounds actually contested; where the complaint fails to engage with the decisive reasoning of the lower court, particularly with a formal non-entry ruling, the requirements of Art. 42 Abs. 2 BGG are not met. A submission confined to the merits of the dispute, without showing why the lower court's formal assessment is arbitrary or otherwise unlawful, is manifestly insufficient and may be disposed of in the summary procedure under Art. 108 BGG. Costs are borne by the unsuccessful complainant under Art. 66 Abs. 1 BGG.

Urteil vom 29. Mai 2013
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Einzelrichter,
Gerichtsschreiberin Arquint Hill.

Verfahrensbeteiligte
X.________,
Beschwerdeführerin,

gegen

Oberstaatsanwaltschaft des Kantons Zürich, Florhofgasse 2, 8001 Zürich,
Beschwerdegegnerin.

Gegenstand
Einstellung,

Beschwerde gegen die Verfügung des Obergerichts des Kantons Zürich, III. Strafkammer, vom 19. April 2013.
Der Einzelrichter zieht in Erwägung:

1.

3.
Dieses Urteil wird den Parteien und dem Obergericht des Kantons Zürich, III. Strafkammer, schriftlich mitgeteilt.

Von Omnilex extrahiert

Kernrechtsfrage

Whether the complaint met the Federal Supreme Court's substantiation requirements.

Extrahierter Entscheid

No. The appellant addressed only the merits and did not explain why the cantonal court's finding of insufficient reasoning was unlawful or arbitrary.

Extrahierte Begründung

The challenged cantonal decision concerned only formal inadmissibility. Since the federal complaint did not engage with that reasoning, it failed to satisfy Art. 42(2) BGG and could not be heard in summary procedure under Art. 108 BGG.

Kernrechtsfrage

Who bears the court costs?

Extrahierter Entscheid

The appellant must bear the court costs.

Extrahierte Begründung

Because the complaint was not entered into, the costs were charged to the appellant under the Federal Supreme Court Act.
