Omnilex-Zusammenfassung

The Federal Supreme Court treated the filing as a criminal-law appeal against the cantonal appellate decision, but it did not enter into the complaint. The appellant lacked standing to challenge the refusal to open criminal investigations and the non-entry on requests against other persons. In addition, constitutional objections were insufficiently reasoned. The request for interim measures became moot. Court costs of CHF 800 were charged to the appellant.

Omnilex-Regeste

Art. 81 Abs. 1 BGG, Art. 106 Abs. 2 BGG, Art. 80 Abs. 1 BGG; standing and reasoning requirements in criminal-law appeals against prosecutorial non-opening decisions. A complainant or injured person lacks legitimization to challenge decisions refusing to open criminal investigations or declining to act against third persons, absent a legally protected position conferring appeal standing. A submission invoking constitutional rights must comply with the specific reasoning duty of Art. 106 Abs. 2 BGG. A prior cantonal order that is not a final decision within the meaning of Art. 80 Abs. 1 BGG cannot be attacked before the Federal Supreme Court. If the appeal is not entered into, court costs are imposed on the appellant pursuant to Art. 66 Abs. 1 BGG.

Urteil vom 6. September 2007
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Oberstaatsanwaltschaft des Kantons Zürich, Postfach, 8090 Zürich.

Gegenstand
Eröffnung einer Untersuchung gegen Behördenmitglieder und Beamte,

Beschwerde gegen den Beschluss des Obergerichts des Kantons Zürich, II. Zivilkammer, vom 12. Juli 2007 (NS070024/U).

Der Präsident zieht in Erwägung:
1.

3.
Dieses Urteil wird dem Beschwerdeführer, der Oberstaatsanwaltschaft des Kantons Zürich und dem Obergericht des Kantons Zürich, II. Zivilkammer, schriftlich mitgeteilt.

Von Omnilex extrahiert

Kernrechtsfrage

Whether the complaint was admissible against the cantonal appellate decision and, in part, against an earlier non-final order.

Extrahierter Entscheid

The filing was treated as a criminal-law appeal against the final cantonal decision, but it was inadmissible insofar as it targeted the earlier non-final order.

Extrahierte Begründung

The challenged decision was a final decision under Art. 90 BGG, but the earlier order of 30 April 2007 was not final within Art. 80(1) BGG and could not be attacked in this proceeding.

Kernrechtsfrage

Whether the appellant had standing to seek review of the refusal to open criminal investigations and the non-entry on requests to prosecute others.

Extrahierter Entscheid

The appellant lacked standing to appeal because a complainant or injured person is not entitled to challenge such prosecutorial decisions in this context.

Extrahierte Begründung

Under Art. 81(1) BGG and the cited case law, the reporting person/injured party is not legitimized to appeal; the constitutional complaints were also insufficiently reasoned under Art. 106(2) BGG.

Kernrechtsfrage

Who bears the court costs of the federal proceedings.

Extrahierter Entscheid

The appellant must pay the court fee.

Extrahierte Begründung

As the appeal was not entered into, costs were imposed on the appellant under Art. 66(1) BGG.
