Omnilex-Zusammenfassung

The Federal Supreme Court did not enter into a criminal complaint by an injured person against a Federal Criminal Court decision. The appellant argued that she was the only injured party not granted a share of seized money because the fraud provision had been wrongly applied, which in substance challenged the acquittal of the accused. The Court held that she lacked standing to contest that acquittal in a criminal appeal. The complaint was therefore inadmissible under Art. 108 BGG. Court costs of CHF 800 were imposed on the appellant.

Omnilex-Regeste

Art. 108 BGG; standing of the injured party to challenge an acquittal in criminal proceedings. An injured person is not legitimized to appeal a judgment insofar as the complaint seeks review of the acquittal of the accused or the substantive application of the offence in question; such a challenge does not concern an admissible civil claim in the sense required for criminal-appeal standing (consid. 1). Where the appeal is not entered into, court costs are borne by the appellant pursuant to Art. 66 Abs. 1 BGG.

Urteil vom 2. Juli 2008
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X._______,
Beschwerdeführerin, vertreten durch Advokat Marco Albrecht,

gegen

Schweizerische Bundesanwaltschaft, Taubenstrasse 16, 3003 Bern,
Beschwerdegegnerin.

Gegenstand
Betrug,
