Omnilex-Zusammenfassung

The complainant appealed to the Federal Supreme Court against a cantonal decision confirming a refusal to proceed on a criminal complaint. He contested both the traffic-rule allegations, which were barred by the finality of the earlier police judgment, and the alleged lies at trial. The Court held that the appeal was not properly reasoned under Art. 42 LTF because the appellant failed to engage with the res judicata reasoning or with the cantonal court’s view that the alleged lies would not amount to a criminal offence. The appeal was declared inadmissible, and judicial costs of CHF 800 were charged to the appellant.

Omnilex-Regeste

Art. 42 al. 1-2 LTF; art. 108 al. 1 let. b LTF: an appeal is inadmissible where the appellant fails to set out, in a reasoned manner, why the challenged decision violates federal law. The appellant must address the decisive grounds of the cantonal decision; merely arguing the merits is insufficient. Where the authority relied on the binding force of a final judgment, the appellant must specifically contest that legal bar. Likewise, when the authority alternatively holds that alleged conduct would not constitute an offence, the appellant must confront that reasoning. If the motivation requirement is not met, summary non-entry is warranted (consid. 1). Costs follow the outcome under art. 66 al. 1 LTF.

Objet

Faits:

A.

Kernrechtsfrage

Whether the appeal challenging the refusal to proceed on the traffic-rule allegations was sufficiently reasoned despite the prior final judgment.

Extrahierter Entscheid

No. The appellant did not show that the appellate court had wrongly applied res judicata, so this part of the appeal lacked the required motivation.

Extrahierte Begründung

Under Art. 42 paras. 1-2 LTF, the appellant must explain briefly why the challenged decision violates the law. He did not address the binding effect of the earlier final judgment of 20 December 2007.

Kernrechtsfrage

Whether the appeal challenging the refusal to proceed on the alleged lies at trial was sufficiently reasoned.

Extrahierter Entscheid

No. The appellant did not explain why the appellate court erred in holding that even if proven, the alleged lies would not constitute a criminal offence.

Extrahierte Begründung

The submission contained no legal argument addressing the federal-law reasoning of the cantonal court.
