Omnilex-Zusammenfassung

The Federal Supreme Court held that the appellant lacked standing to challenge the Zurich decision refusing to open an investigation against officials. He was neither a private prosecutor nor a victim under the Victim Assistance Act, and he had no legally protected interest in the civil-law aspect. The complaint was therefore not entered into. His request for legal aid was rejected as the appeal was hopeless, and he was ordered to pay a reduced court fee of CHF 500.

Omnilex-Regeste

Art. 81 Abs. 1 lit. b Ziff. 4 und 5 BGG; Art. 2 Abs. 1 OHG; standing to appeal in criminal matters: A complainant is entitled to appeal only if he qualifies as private prosecutor or as a victim directly affected in bodily or psychological integrity, or if he otherwise has a legally protected interest in the annulment or modification of the decision. Mere dissatisfaction with the opening of criminal proceedings or with the treatment of ancillary civil issues does not suffice. Where standing is lacking, the appeal is not entered into under Art. 108 BGG; hopeless requests for legal aid are to be refused under Art. 64 BGG, with costs allocated under Art. 66 BGG and the fee possibly reduced under Art. 65 Abs. 2 BGG.

Urteil vom 12. August 2007
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Oberstaatsanwaltschaft des Kantons Zürich, Postfach, 8090 Zürich.

Gegenstand
Eröffnung einer Untersuchung gegen Behördenmitglieder und Beamte (Amtsmissbrauch etc.),

Beschwerde in Strafsachen gegen den Beschluss des Obergerichts des Kantons Zürich, II. Zivilkammer, vom 29. Juni 2007.

Der Präsident zieht in Erwägung:
1.

4.
Dieses Urteil wird dem Beschwerdeführer, der Oberstaatsanwaltschaft des Kantons Zürich und dem Obergericht des Kantons Zürich, II. Zivilkammer, schriftlich mitgeteilt.

Kernrechtsfrage

Whether the appellant had standing to bring the criminal appeal

Extrahierter Entscheid

He lacked standing because he was neither a private prosecutor nor an injured party with direct impairment of bodily or psychological integrity, and he had no legally protected interest regarding the civil claim aspect.

Extrahierte Begründung

The prosecution had participated in the cantonal proceedings, so private-prosecutor status was excluded. The alleged conduct did not meet the victim definition under the Victim Assistance Act, and there was no protected interest as to the civil point.

Kernrechtsfrage

Whether legal aid should be granted

Extrahierter Entscheid

Legal aid was denied because the appeal was manifestly without prospects of success.

Extrahierte Begründung

Since the appeal was not admissible, the requests were hopeless from the outset.

Kernrechtsfrage

Allocation of court costs

Extrahierter Entscheid

Court costs were imposed on the appellant, with a reduced fee reflecting his financial situation.

Extrahierte Begründung

Costs follow the outcome; the fee was reduced in view of the appellant’s financial circumstances.
