Non-entry for failure to submit challenged decision

Omnilex-Zusammenfassung

The Federal Criminal Division, by its president, refused to enter into the appellant’s submission because he did not comply with the order to file the challenged decision by the stated deadline. The court also held that his vague allegation of denial of justice did not meet the reasoning requirements and did not show a violation of Swiss law. Exceptionally, no costs were imposed.

Omnilex-Regeste

Art. 42 and 106 Abs. 2 BGG; Art. 108 Abs. 2 BGG: A federal appeal is inadmissible if the appellant fails, despite a court order, to submit the challenged decision within the prescribed time limit. A merely insinuated denial of justice does not satisfy the reasoning requirement unless the submission indicates, in a substantiated manner, which federal law was violated and how. Where these formal requirements are not met, the court may decide by summary procedure not to enter into the appeal; costs may exceptionally be waived.

Urteil vom 18. Mai 2009
Strafrechtliche Abteilung

Besetzung
Bundesrichter Favre, Präsident,
Gerichtsschreiberin Arquint Hill.

Parteien

Unbekannter Beschwerdegegner,
Beschwerdegegner.

Gegenstand
Unbekannt,

Der Präsident zieht in Erwägung:

1.

2.
Ausnahmsweise kann auf eine Kostenauflage verzichtet werden.

Demnach erkennt der Präsident:

1.
Auf die Beschwerde wird nicht eingetreten.

2.
Es werden keine Kosten erhoben.

3.
Dieses Urteil wird dem Beschwerdeführer schriftlich mitgeteilt.

Von Omnilex extrahiert

Kernrechtsfrage

Whether the appeal was admissible despite the appellant failing to file the challenged decision by the deadline.

Extrahierter Entscheid

The filing did not satisfy the formal requirements, so the court would not enter into the appeal.

Extrahierte Begründung

The appellant ignored the instruction to submit the challenged decision by 11 May 2009; therefore the submission was disregarded under Art. 42 BGG and non-entry followed under Art. 108(2) BGG.

Kernrechtsfrage

Whether the alleged denial of justice was sufficiently reasoned to allow review.

Extrahierter Entscheid

The allegation was not adequately substantiated and no violation of Swiss law was apparent.

Extrahierte Begründung

The submission did not explain how the communication of the district court president violated Swiss law within the meaning of Art. 95 BGG; the reasoning requirements of Arts. 42 and 106(2) BGG were not met.
