Omnilex-Zusammenfassung

The appellant asked the Federal Supreme Court to order cantonal authorities to grant him immediate and unrestricted access to all federal and cantonal enactments. The Criminal Division held that he did not identify any legal basis for such a duty and did not explain how he was unlawfully restricted. The complaint therefore did not satisfy the requirements for review and was not entered into under Art. 108 BGG. Court costs were waived.

Omnilex-Regeste

Art. 108 BGG; non-entry for insufficiently substantiated complaint. A complaint must state the legal basis of the requested relief and set out, in a comprehensible manner, why the challenged refusal infringes the complainant’s rights. Where the pleading merely demands access to legislation without identifying a duty of the authorities or demonstrating the alleged restriction, the court may refuse to enter into the matter in summary procedure (consid. 1).

Urteil vom 4. April 2011
Strafrechtliche Abteilung

Besetzung
Bundesrichter Favre, Präsident,
Gerichtsschreiber C. Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

unbekannt.

Gegenstand
Straf- und Massnahmenvollzug.

Der Präsident zieht in Erwägung:

1.

2.
Auf Gerichtskosten kann verzichtet werden.

Demnach erkennt der Präsident:

1.
Auf die Beschwerde wird nicht eingetreten.

2.
Es werden keine Gerichtskosten erhoben.

3.
Dieses Urteil wird dem Beschwerdeführer schriftlich mitgeteilt.

Kernrechtsfrage

Whether the complaint was sufficiently substantiated to require the authorities to grant unrestricted access to all federal and cantonal enactments.

Extrahierter Entscheid

The complaint did not identify any legal basis for such a duty or explain how the alleged refusal unlawfully restricted the appellant.

Extrahierte Begründung

Because the appellant failed to cite any provision imposing the requested obligation and did not show in what respect he was unlawfully restricted, the complaint was inadmissible in summary non-entry proceedings under Art. 108 BGG.
