Omnilex-Zusammenfassung

X. filed a criminal complaint against Y. for false testimony. After the Geneva Chambre d'accusation declared his cantonal appeal inadmissible, X. appealed to the Federal Supreme Court. The Court held that the federal appeal did not address the decisive procedural ground, namely the inadmissibility of the cantonal appeal for lack of motivated conclusions. The appeal was therefore declared inadmissible, and court costs of CHF 800 were charged to X.

Omnilex-Regeste

Art. 42 al. 1-2 LTF; Art. 108 al. 1 let. b LTF; admissibility of the federal appeal requires substantiated criticism of the contested decision. Where the cantonal authority declared the appeal inadmissible on procedural grounds, the appellant must specifically show why that procedural ruling is unlawful; arguments confined to the merits are insufficient. Failure to challenge the admissibility reasoning leads to non-entry in summary proceedings (consid. 1). Costs follow the outcome and may be reduced in single-judge proceedings (consid. 2).

Arrêt du 18 janvier 2010
Cour de droit pénal

Composition
M. le Juge Favre, Président.
Greffier: M. Oulevey.

Parties
X.________,
recourant,

contre

Procureur général du canton de Genève, 1211 Genève 3,
intimé.

Objet

Faits:

A.

Kernrechtsfrage

Whether the federal appeal met the substantiation requirements of Art. 42 LTF.

Extrahierter Entscheid

No. The appellant argued only on the merits and did not explain why the cantonal appeal was admissible in form.

Extrahierte Begründung

Under Art. 42 paras. 1-2 LTF, the appeal must briefly show how the challenged decision violates the law. Because the attacked decision primarily found the cantonal appeal inadmissible for lack of motivated requests, the federal appeal had to address that procedural ground. It did not, so inadmissibility followed under Art. 108 para. 1 lit. b LTF.
