Appeal inadmissible for nonpayment of cost advance

6A.116/2006Bundesgericht / Strafrechtliche Abteilung08.02.2007Inadmissible

Zusammenfassung

The Federal Supreme Court was seized of an administrative appeal against a precautionary withdrawal of a driving license. After ordering the appellant to pay a CHF 1,000 cost advance, the court noted that the advance was not paid. It held that no additional grace period had to be granted in the present case and therefore decided as threatened in the warning order. The appeal was not entered into, and the appellant was ordered to pay the federal court fee of CHF 500.

Regest

Art. 62 Abs. 3 BGG, Art. 132 Abs. 1 BGG; non-payment of an ordered cost advance and non-entry into the appeal. Where the appellant fails to pay the required advance within the set time limit, the court may decide according to the warning order. The duty to fix an additional grace period under Art. 62 Abs. 3 BGG does not apply where Art. 132 Abs. 1 BGG excludes it. In such circumstances, the remedy is not entered into and the costs are charged to the appellant (consid. 1–2).

Urteil vom 8. Februar 2007
Kassationshof

Besetzung
Bundesrichter Schneider, Präsident,
Bundesrichter Favre, Zünd,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Regierungsrat des Kantons Zürich, Kaspar Escher‑Haus, 8090 Zürich.

Gegenstand

November 2006.

Das Bundesgericht zieht in Erwägung:
1.
