Omnilex-Zusammenfassung

The Federal Tribunal dismissed as inadmissible a subsidiary constitutional complaint against a Geneva ruling that had itself declared inadmissible an appeal concerning provisional lifting of opposition. The appellant did not allege any violation of constitutional rights and failed to engage with the cantonal reasoning, offering only brief substantive objections. The Court held that this did not satisfy the strict reasoning requirements for constitutional complaints and decided the case under the simplified procedure. Judicial costs of CHF 200 were imposed on the appellant.

Omnilex-Regeste

Arts. 116, 117 and 106 para. 2 LTF; subsidiarity and reasoning requirements of the constitutional complaint. A subsidiary constitutional complaint is inadmissible where the complainant neither invokes a specific constitutional right nor substantiates an arbitrary application or other constitutional violation by confronting the decisive reasoning of the cantonal judgment. Merely presenting summary substantive criticism is insufficient. In such a case, the Federal Tribunal may refuse entry in simplified procedure pursuant to Art. 108 para. 1 let. b LTF; costs follow the outcome under Art. 66 para. 1 LTF.

Objet
mainlevée d'opposition,

recours constitutionnel contre l'arrêt de la Chambre civile de la Cour de justice du canton de Genève du 4 octobre 2011.

Considérant:
que, par arrêt du 4 octobre 2011, la Cour de justice du canton de Genève a déclaré irrecevable l'appel formé par A.________ contre le prononcé de la mainlevée provisoire de l'opposition dans la poursuite exercée par Fondation B.________;
que cette décision retient que le recours ne satisfaisait pas aux exigences de recevabilité posées par l'art. 321 al. 1 CPC, faute de motivation suffisante, et, qu'au demeurant, il serait mal fondé, les conditions pour prononcer la mainlevée provisoire étant manifestement réalisées;
que, par écritures remises à la poste le 28 octobre 2011, A.________ interjette un recours constitutionnel subsidiaire au Tribunal fédéral contre cette décision;
que, toutefois, le recourant n'invoque la violation d'aucun droit constitutionnel ni ne prétend que l'arrêt cantonal serait arbitraire (art. 106 al. 2 LTF);
qu'en outre, il ne s'en prend pas aux considérants de l'arrêt cantonal mais fait valoir de manière sommaire des griefs matériels;
qu'une telle argumentation est manifestement insuffisante au regard des exigences légales en la matière (art. 116, 117 et 106 al. 2 LTF; ATF 133 IV 286 consid. 1.4);
que le recours doit dès lors être déclaré irrecevable selon la procédure simplifiée prévue aux art. 117 et 108 al. 1 let. b LTF;
que les frais de la présente procédure doivent être mis à la charge du recourant (art. 66 al. 1 LTF);

par ces motifs, la Présidente prononce:

1.
Le recours est irrecevable.

2.
Les frais judiciaires, arrêtés à 200 fr., sont mis à la charge du recourant.

3.
Le présent arrêt est communiqué aux parties et à la Chambre civile de la Cour de justice du canton de Genève.

Lausanne, le 2 novembre 2011

Kernrechtsfrage

Whether the subsidiary constitutional complaint complied with the requirement to invoke and substantiate a constitutional violation.

Extrahierter Entscheid

It did not. The complaint contained no constitutional grounds and did not challenge the cantonal reasoning in a legally sufficient manner.

Extrahierte Begründung

Under Art. 106(2) LTF, applicable via Arts. 116 and 117 LTF, a constitutional complaint must clearly identify the violated constitutional right and address the contested reasoning. Mere summary substantive criticism is insufficient.

Kernrechtsfrage

Allocation of the costs of the federal proceedings

Extrahierter Entscheid

The judicial costs were imposed on the appellant.

Extrahierte Begründung

As the complaint was inadmissible, the appellant had to bear the costs under Art. 66(1) LTF.
