Omnilex-Zusammenfassung

The Federal Supreme Court dealt with a constitutional complaint against a cantonal decision granting provisional release from objection in debt enforcement for CHF 5,928.95. It held that, because the amount in dispute was below the threshold and no legal question of principle was alleged, only a constitutional complaint was possible. The complainant, however, did not invoke any constitutional right or substantiate such a claim. The court therefore declared the complaint inadmissible and charged court costs of CHF 700 to the complainant.

Omnilex-Regeste

Art. 113 ss, 116, 106 al. 2 and 117 LTF; admissibility and pleading requirements of the constitutional complaint: where the value in dispute does not reach the threshold of Art. 74 al. 1 let. b LTF and no question juridique de principe is alleged, the remedy is limited to the constitutional complaint. In such proceedings, the Federal Supreme Court examines violations of fundamental rights only if they are expressly raised and duly reasoned; a mere appeal-like critique does not satisfy Art. 106 al. 2 LTF by virtue of Art. 117 LTF. Failure to comply with these substantiation requirements leads to inadmissibility under Art. 108 al. 1 let. b LTF and the judicial costs are borne by the complainant under Art. 66 al. 1 LTF.

Objet
mainlevée d'opposition,

recours constitutionnel contre l'arrêt de la Cour de cassation civile du Tribunal cantonal du canton de Neuchâtel du 18 novembre 2009.

considérant:
que l'arrêt attaqué prononce la mainlevée provisoire de l'opposition formée par le recourant à un commandement de payer la somme de 5'928 fr. 95;
que le débiteur interjette un recours au Tribunal fédéral contre cet arrêt;
que son recours doit être traité en tant que recours constitutionnel au sens des art. 113 ss LTF, dès lors que la valeur litigieuse est inférieure à 30'000 fr. (art. 74 al. 1 let. b LTF) et que le recourant ne soutient pas qu'on soit en présence d'une question juridique de principe (art. 74 al. 2 let. a LTF);
que seule la violation des droits constitutionnels peut être invoquée dans le cadre du recours constitutionnel (art. 116 LTF);
que, saisi d'un tel recours, le Tribunal fédéral ne connaît de la violation de droits fondamentaux que si ce grief a été invoqué et motivé par le recourant (art. 106 al. 2, par renvoi de l'art. 117 LTF);
que, en l'espèce, le recours ne satisfait aucunement à ces exigences, le recourant n'invoquant la violation d'aucun droit constitutionnel;
que, dès lors, le recours doit être déclaré irrecevable (art. 108 al. 1 let. b LTF), aux frais de son auteur (art. 66 al. 1 LTF);
que le présent arrêt relève de la compétence du juge unique (art. 108 al. 1 LTF);

par ces motifs, la Présidente prononce:

1.
Le recours est irrecevable.

2.
Les frais judiciaires, arrêtés à 700 fr., sont mis à la charge du recourant.

3.
Le présent arrêt est communiqué aux parties et à la Cour de cassation civile du Tribunal cantonal du canton de Neuchâtel.

Kernrechtsfrage

Admissibility of the constitutional complaint despite the low value in dispute

Extrahierter Entscheid

The complaint was not admissible as an ordinary appeal and could only be examined as a constitutional complaint, but it failed to meet the required constitutional pleading standard.

Extrahierte Begründung

The amount in dispute was below CHF 30,000 and no legal question of principle was invoked; under a constitutional complaint only constitutional rights may be raised, and they must be specifically alleged and reasoned.

Kernrechtsfrage

Allocation of federal court costs

Extrahierter Entscheid

Court costs were imposed on the complainant.

Extrahierte Begründung

Because the complaint was inadmissible, the unsuccessful party had to bear the judicial costs.
