Omnilex-Zusammenfassung

The Federal Supreme Court held that the constitutional complaint against the Aargau District Court President’s order granting provisional debt enforcement release was inadmissible because it was not directed against a final cantonal decision. An appeal to the Aargau High Court remained available under cantonal procedure, so the subsidiarity requirement of the constitutional complaint was not met. The Court further observed that the pleading would in any event not satisfy the statutory reasoning requirements. The complaint was not entered into, and the complainant was ordered to pay CHF 300 in costs.

Omnilex-Regeste

Art. 113 BGG; subsidiarity of the constitutional complaint and requirement of a decision by the last cantonal instance. A constitutional complaint is admissible only against decisions of the final cantonal authority; where an ordinary cantonal appeal remains available, the Federal Supreme Court must not enter into the matter (consid. 1). Defective reasoning under Arts. 116, 117 and 106(2) BGG constitutes an additional ground of inadmissibility, but need not be examined once the absence of a final cantonal decision is established. In simplified procedure under Art. 117 in conjunction with Art. 108 Abs. 1 lit. a BGG, non-entry may be pronounced by the divisional president.

Urteil vom 28. Dezember 2010
II. zivilrechtliche Abteilung

Besetzung
Bundesrichterin Hohl, Präsidentin,
Gerichtsschreiber Füllemann.

Verfahrensbeteiligte
X.________,
Beschwerdeführerin,

gegen

Z.________.
Beschwerdegegnerin.

Gegenstand

in Erwägung,

Kernrechtsfrage

Whether the constitutional complaint was admissible without a final cantonal decision

Extrahierter Entscheid

No. The challenged decision was not issued by the last cantonal instance because an appeal to the Aargau High Court was still available.

Extrahierte Begründung

Under Art. 113 BGG, only decisions of the last cantonal instance may be attacked by constitutional complaint. Since the complainant could still appeal under §§ 335 ff. ZPO/AG, the Federal Supreme Court could not enter into the complaint.

Kernrechtsfrage

Whether the complaint met the constitutional complaint pleading requirements

Extrahierter Entscheid

No. The filing would also have been inadmissible because it did not satisfy the reasoning requirements of Arts. 116 and 117 in conjunction with Art. 106(2) BGG.

Extrahierte Begründung

The court noted additional shortcomings in the substantiation of the complaint, but these were not decisive because the lack of a final cantonal decision already prevented entry.

Kernrechtsfrage

Court costs

Extrahierter Entscheid

The complainant must bear court costs of CHF 300.

Extrahierte Begründung

Costs follow the losing party under Art. 66(1) BGG.
