The Federal Supreme Court noted the appellant’s withdrawal of his constitutional appeal against the cantonal judgment ordering interim measures in a divorce matter. It therefore struck the case from the docket. The court ordered the appellant to pay a judicial fee of CHF 300. No reduced party costs were awarded to the respondent because the invitation to comment on the suspension request had been revoked.

les art. 32 al. 2 LTF et 73 PCF en relation avec l'art. 71 LTF;
considérant:
qu'il convient de prendre acte du retrait et de rayer la cause du rôle (art. 73 PCF par renvoi de l'art. 71 LTF; art. 32 al. 2 LTF);
que l'émolument judiciaire incombe au recourant (art. 66 al. 1 LTF);
qu'il n'y a pas lieu d'allouer des dépens réduits à l'intimée dont l'invitation à se déterminer sur la requête d'effet suspensif a été révoquée;
par ces motifs, la Présidente ordonne:

La cause est rayée du rôle par suite de retrait du recours.
2.
Un émolument judiciaire de 300 fr. est mis à la charge du recourant.
3.
La présente ordonnance est communiquée aux parties, au Tribunal civil de l'arrondissement de la Sarine et à la Ie Cour d'appel civil du Tribunal cantonal de l'Etat de Fribourg.

The court took note of the withdrawal and struck the case from the docket.
Under Art. 73 PCF in conjunction with Art. 71 LTF and Art. 32(2) LTF, the withdrawal requires removal of the case from the docket.
