The appellant withdrew her appeal by letter of 14 January 2011. The Federal Supreme Court therefore discontinued the proceedings by order of 18 January 2011. It refused to waive costs and ordered the appellant to pay court costs of CHF 300, noting that costs would in any event have been imposed because the appeal’s inadmissibility was foreseeable due to the absence of exhaustion of cantonal remedies.

Costs may also be imposed where inadmissibility of the appeal was foreseeable, in particular for failure to exhaust cantonal remedies (consid. 1).

Januar 2011 zurückgezogen hat, die Beschwerde daher durch die Abteilungspräsidentin (Art. 32 Abs. 2 BGG) abzuschreiben ist (Art. 71 BGG i.V.m. Art. 73 BZP), entgegen dem Antrag der Beschwerdeführerin kein Grund für einen Kostenverzicht besteht, Kosten vielmehr zu erheben und diese der (die Beschwerde zurückziehenden) Beschwerdeführerin aufzuerlegen sind (Art. 71 BGG i.V.m. Art. 5 Abs. 2 BZP, Art. 66 Abs. 1 BGG) unter Hinweis darauf, dass die Kosten auch bei Gegenstandsloserklärung der Beschwerdeführerin, welche die Unzulässigkeit der Beschwerde mangels Erschöpfung des kantonalen Instanzenzugs hätte voraussehen können, auferlegt worden wären,
verfügt die Präsidentin:

Das Verfahren 5A_663/2010 wird als durch Rückzug der Beschwerde erledigt abgeschrieben.

Die Gerichtskosten von Fr. 300.-- werden der Beschwerdeführerin auferlegt.

Diese Verfügung wird den Parteien, dem Gerichtspräsidenten 2 des Gerichtskreises V Burgdorf-Fraubrunnen und dem Appellationshof des Kantons Bern schriftlich mitgeteilt.

A withdrawn appeal is to be struck from the docket under Art. 32 para. 2 BGG and Art. 71 BGG in conjunction with Art. 73 BZP.

The court costs were imposed on the withdrawing appellant.
There was no reason to waive costs; under Art. 71 BGG in conjunction with Art. 5 para. 2 BZP and Art. 66 para. 1 BGG, costs are charged to the party withdrawing the appeal, especially since inadmissibility would have been foreseeable.
