The appellant withdrew her appeal against provisional measures in divorce proceedings. Whether the appeal should be taken off the docket after withdrawal.
The Court took note of the withdrawal and struck the case from the docket.
Once the appellant withdrew the appeal, there was no longer a need to decide the merits; the case had to be removed from the docket.
Who bears the court fee after withdrawal of the appeal.
The court fee was charged to the appellant.
Under Art. 66(1) LTF, the unsuccessful party or the party causing the proceedings to end by withdrawal bears the judicial fee.
