The appellant withdrew its civil appeal concerning bankruptcy-administrator fees after the federal proceedings had been suspended pending an interpretation request before the cantonal supervisory authority. The Federal Supreme Court took note of the withdrawal and removed the case from the docket. It ordered the appellant to pay a judicial fee of CHF 500 and instructed respondent's counsel to return the file to the court by 20 April 2007 so it could then be forwarded back to the cantonal authority.
Art. 73 PCF in conjunction with Art. 71 LTF; Art. 32 al. 2 LTF: where an appeal is withdrawn, the Federal Supreme Court merely takes note of the withdrawal and removes the case from the docket, without deciding the merits. The costs of the proceeding are borne by the withdrawing appellant pursuant to Art. 5 al. 2 PCF in conjunction with Art. 71 LTF and Art. 66 al. 1 LTF. The Court may, in line with its practice, order counsel to return the file so that it can be forwarded back to the lower authority.

l'arrêt rendu par cette dernière le 22 mars 2007;
la demande d'avance de frais du 26 mars 2007;
l'envoi du dossier de la cause au conseil de l'intimé le 2 avril 2004, pour consultation, sur demande de celui-ci;
la déclaration de retrait du recours du 4 avril 2007;
Considérant:
qu'il convient de prendre acte de ce retrait et de rayer la cause du rôle (art. 73 PCF par renvoi de l'art. 71 LTF; art. 32 al. 2 LTF);
que les frais doivent être mis à la charge du recourant (art. 5 al. 2 PCF par renvoi de l'art. 71 LTF; art. 66 al. 1 LTF);
qu'il y a lieu, par ailleurs, d'inviter le conseil de l'intimé à renvoyer le dossier de la cause au Tribunal fédéral pour que celui-ci puisse, conformément à la pratique, le retourner lui-même à l'autorité cantonale;
Par ces motifs, le Président de la IIe Cour de droit civil:

Prend acte du retrait du recours et ordonne la radiation de la cause du rôle.
2.
Met un émolument judiciaire de 500 fr. à la charge du recourant.
3.
Impartit au conseil de l'intimé un délai échéant le 20 avril 2007 pour retourner le dossier de la cause au Tribunal fédéral.
4.
Communique la présente ordonnance en copie aux parties et à l'Autorité cantonale supérieure de surveillance des offices des poursuites et des faillites du canton de Neuchâtel.

Whether the withdrawn appeal should still be adjudicated on the merits
The court took note of the withdrawal and struck the case from the docket.
Once the appellant withdrew the appeal, there was no longer a need to decide the merits; the case had to be removed from the roll.
Who bears the court costs after withdrawal of the appeal
Court costs were imposed on the appellant.
Because the appeal was withdrawn, the costs were allocated to the appellant under the applicable procedural rules.
Return of the case file after counsel's consultation
Counsel for the respondent was ordered to return the file to the Federal Supreme Court by the stated deadline.
The court followed its usual practice of having the file returned through the Federal Supreme Court before it is sent back to the cantonal authority.
