In a divorce appeal to the Federal Supreme Court, the appellant withdrew his complaint by letter after filing it against the decision of the Zurich Cantonal Court. The President of the II. Civil Law Division therefore struck the proceedings from the docket as withdrawn and imposed court costs of CHF 300 on the appellant. The order was notified to the parties and the cantonal court.

Art. 73 BZP) und die Kosten dem Beschwerdeführer aufzuerlegen sind (Art. 71 BGG i.V.m. Art. 5 Abs. 2 BZP, Art. 66 Abs. 1 und 5 BGG),
verfügt die Präsidentin:

Das Verfahren wird als durch Rückzug der Beschwerde erledigt abgeschrieben.
2.
Die Gerichtskosten von Fr. 300.-- werden dem Beschwerdeführer auferlegt.
3.
Diese Verfügung wird den Parteien und dem Obergericht des Kantons Zürich, I. Zivilkammer, schriftlich mitgeteilt.

The appellant withdrew the filing by letter of 6 May 2009, so the President could discontinue the appeal under Art. 32(2) BGG in conjunction with Art. 71 BGG and Art. 73 BZP.
How the court costs should be allocated after withdrawal.
Court costs of CHF 300 were imposed on the appellant.
Because the appeal was withdrawn, the costs were charged to the appellant under Art. 71 BGG in conjunction with Art. 5(2) BZP and Art. 66(1) and (5) BGG.
