Omnilex-Zusammenfassung

The husband filed a federal appeal against a Geneva decision that had declared his cantonal appeal against protective measures of the matrimonial union late. The Federal Tribunal treated the filing as a civil-law appeal, but found the reasoning manifestly insufficient: the appellant mainly attacked the first-instance decision and failed to address the cantonal court’s lateness finding with specific arguments. The appeal was therefore declared inadmissible in simplified procedure. Legal aid was refused because the appeal had no prospects of success, and court costs of CHF 500 were imposed on the appellant.

Omnilex-Regeste

Art. 42 al. 2, 75 al. 1 and 106 al. 2 LTF; simplified procedure under Art. 108 al. 1 let. b LTF: a civil-law appeal is inadmissible where the submission does not specifically challenge the cantonal appellate reasoning and instead targets only the first-instance judgment. The Federal Tribunal requires a topically reasoned criticism of the last cantonal instance; bare references or generic complaints do not satisfy the motivation requirement. Where the appeal is manifestly inadmissible, legal aid must be refused under Art. 64 al. 1 LTF, and the judicial costs are borne by the appellant pursuant to Art. 66 al. 1 LTF.

Objet
mesures protectrices de l'union conjugale,

recours contre l'arrêt de la Chambre civile
de la Cour de justice du canton de Genève
du 10 février 2010.

Considérant:
que, par arrêt du 10 février 2010, la Chambre civile de la Cour de justice du canton de Genève a déclaré irrecevable, en raison de sa tardiveté, un appel déposé par X.________ contre un prononcé de mesures protectrices de l'union conjugale relatif notamment à l'attribution de la garde de l'enfant des parties et aux questions patrimoniales qui lui sont liées;
que l'intéressé interjette un recours constitutionnel subsidiaire au Tribunal fédéral contre cet arrêt;
qu'il sollicite, en outre, le bénéfice de l'assistance judiciaire;
que son recours doit être traité comme recours en matière civile, lequel est recevable contre une telle décision, indépendamment de la valeur litigieuse (arrêts 5A_220/2009 du 30 juin 2009 consid. 1; 5A_49/2008 du 19 août 2008 consid. 1);
que l'argumentation présentée par le recourant est toutefois manifestement insuffisante au regard des exigences légales de motivation (art. 42 al. 2 et 106 al. 2 LTF; ATF 133 IV 286 consid. 1.4 p. 287);
que, en effet, en tant qu'il critique le prononcé de première instance, son recours est irrecevable, dès lors qu'il n'est pas dirigé contre un arrêt de dernière instance cantonale (art. 75 al. 1 LTF);
que, par ailleurs, dans la mesure où il est dirigé - implicitement - contre l'arrêt de la cour cantonale, une motivation topique, relative à la tardiveté de l'appel constatée par les juges précédents, fait défaut (art. 42 al. 2 et 106 al. 2 LTF);
que, manifestement irrecevable, le présent recours doit être traité selon la procédure simplifiée prévue à l'art. 108 al. 1 let. b LTF;
que, vu l'issue prévisible du recours, la requête d'assistance judiciaire doit être rejetée (art. 64 al. 1 LTF);
que les frais judiciaires incombent au recourant (art. 66 al. 1 LTF);

par ces motifs, la Présidente prononce:

1.
Le recours est irrecevable.

2.
La requête d'assistance judiciaire est rejetée.

3.
Les frais judiciaires, arrêtés à 500 fr., sont mis à la charge du recourant.

4.
Le présent arrêt est communiqué aux parties et à la Chambre civile de la Cour de justice du canton de Genève.

Kernrechtsfrage

Admissibility of the federal appeal against the cantonal judgment

Extrahierter Entscheid

The appeal was inadmissible because the arguments did not meet the federal motivation requirements and the challenge to the first-instance order was not directed against a final cantonal decision.

Extrahierte Begründung

The filing had to be treated as a civil-law appeal, but the submission lacked a specific challenge to the cantonal court's finding of lateness and instead attacked the first-instance ruling, contrary to the requirement of a last cantonal instance and sufficient reasoning.

Kernrechtsfrage

Request for legal aid

Extrahierter Entscheid

Legal aid was refused because the appeal had no prospect of success.

Extrahierte Begründung

Given the manifest inadmissibility of the appeal, success was not foreseeable within the meaning of the legal-aid rule.

Kernrechtsfrage

Allocation of court costs

Extrahierter Entscheid

Court costs were imposed on the appellant.

Extrahierte Begründung

The losing party must bear the judicial fees.
