Omnilex-Zusammenfassung

The claimant appealed a cantonal decision that had declared his appeal against the dismissal of his CHF 19,602.90 payment claim inadmissible. The Federal Supreme Court held that an ordinary civil appeal was unavailable because the dispute value did not reach CHF 30,000 and no fundamental legal question was shown. It therefore treated the filing as a subsidiary constitutional complaint, but found no sufficiently substantiated constitutional arguments. The complaint was manifestly inadmissible and no entry was made. Court costs of CHF 500 were imposed on the appellant.

Omnilex-Regeste

Art. 74 Abs. 1 lit. b und Abs. 2 lit. a, Art. 113 ff., Art. 116, Art. 42 Abs. 2, Art. 106 Abs. 2 und Art. 117 BGG; subsidiäre Verfassungsbeschwerde and pleading requirements. Where the amount in dispute does not reach the statutory threshold and no question of fundamental importance is raised, an ordinary appeal in civil matters is unavailable. A filing may be treated as a subsidiary constitutional complaint, but only violations of constitutional rights may be invoked; such grievances must be expressly identified and reasoned with reference to the challenged decision. A merely appellatory or unsubstantiated submission is manifestly inadmissible, warranting non-entry under Art. 108 Abs. 1 lit. b BGG. Costs follow the outcome under Art. 66 Abs. 1 BGG.

Gegenstand
Auftrag; Anwaltstätigkeit,

Verfassungsbeschwerde gegen die Verfügung des Kantonsgerichts Schwyz, Kantonsgerichtsvizepräsidentin, vom 20. Dezember 2011.
In Erwägung,
dass das Bezirksgericht Höfe mit Urteil vom 22. August 2011 eine Klage des Beschwerdeführers gegen den Beschwerdegegner auf Zahlung von total Fr. 19'602.90 abwies, soweit es darauf eintrat;
dass das Kantonsgericht Schwyz mit Verfügung vom 20. Dezember 2011 auf die vom Beschwerdeführer gegen das Urteil des Bezirksgerichts erhobene Berufung nicht eintrat;
dass der Beschwerdeführer dem Bundesgericht eine vom 21. Januar 2012 datierte Eingabe einreichte, aus der sich ergibt, dass er den Entscheid des Kantonsgerichts anfechten will;
dass das Bundesgericht von Amtes wegen prüft, ob ein Rechtsmittel zulässig ist (BGE 137 III 417 E. 1; 136 II 101 E. 1, 470 E. 1; 135 III 212 E. 1);
dass gegen die Verfügung des Kantonsgerichts eine Beschwerde in Zivilsachen im vorliegenden Fall nicht zulässig ist, weil der erforderliche Streitwert von Fr. 30'000.-- (Art. 74 Abs. 1 lit. b BGG) nicht erreicht wird und sich keine Rechtsfrage von grundsätzlicher Bedeutung im Sinne von Art. 74 Abs. 2 lit. a BGG stellt;
dass die Eingabe des Beschwerdeführers unter diesen Umständen als subsidiäre Verfassungsbeschwerde im Sinne von Art. 113 ff. BGG zu behandeln ist;
dass mit einer subsidiären Verfassungsbeschwerde nur die Verletzung von verfassungsmässigen Rechten gerügt werden kann (Art. 116 BGG);
dass in der Beschwerdeschrift dargelegt werden muss, welche verfassungsmässigen Rechte durch das kantonale Gericht verletzt worden sind, und solche Rügen unter Bezugnahme auf die Erwägungen des angefochtenen Entscheides zu begründen sind (Art. 42 Abs. 2 und Art. 106 Abs. 2 in Verbindung mit Art. 117 BGG);
dass die Eingabe der Beschwerdeführers keine auch nur im Ansatz substanziierte Verfassungsrüge enthält;
dass aus diesen Gründen auf die offensichtlich unzulässige Beschwerde im Verfahren nach Art. 108 Abs. 1 lit. b BGG nicht einzutreten ist;
dass die Kosten des bundesgerichtlichen Verfahrens dem Verfahrensausgang entsprechend dem Beschwerdeführer aufzuerlegen sind (Art. 66 Abs. 1 BGG);

erkennt die Präsidentin:

1.
Auf die Beschwerde wird nicht eingetreten.

2.

Kernrechtsfrage

Whether an appeal in civil matters was admissible despite the amount in dispute being below CHF 30,000 and no fundamental legal question being raised.

Extrahierter Entscheid

The ordinary civil appeal was not admissible because the statutory amount in dispute was not reached and no question of fundamental importance existed.

Extrahierte Begründung

The challenged decision concerned a claim of CHF 19,602.90, below the threshold of Art. 74(1)(b) BGG, and the case did not present a fundamental legal question under Art. 74(2)(a) BGG.

Kernrechtsfrage

Whether the filing could be treated as a subsidiary constitutional complaint and met its pleading requirements.

Extrahierter Entscheid

The filing was treated as a subsidiary constitutional complaint, but it was inadmissible because it did not contain any substantiated constitutional grievances.

Extrahierte Begründung

A subsidiary constitutional complaint may only invoke constitutional rights and must identify and substantiate specific violations with reference to the reasoning of the challenged decision. The submission contained no such arguable constitutional claim.

Kernrechtsfrage

Whether the Federal Supreme Court should enter into the complaint under summary inadmissibility procedure.

Extrahierter Entscheid

The complaint was manifestly inadmissible and the Court did not enter into it.

Extrahierte Begründung

Because no admissible federal remedy was available and the filing lacked substantiated constitutional arguments, non-entry under Art. 108(1)(b) BGG was appropriate.

Kernrechtsfrage

Allocation of federal court costs.

Extrahierter Entscheid

Court costs were imposed on the appellant.

Extrahierte Begründung

Costs follow the outcome of the proceedings under Art. 66(1) BGG.
