Omnilex-Zusammenfassung

The Federal Supreme Court dealt with a constitutional appeal against a Ticino cassation decision in a small contractual-fee dispute. It held that the appellant's submission did not satisfy the reasoning requirement of Art. 42(2) BGG, as it merely reiterated her objections and did not show any arbitrary application of Art. 329(2) CPC/TI. The appeal was therefore inadmissible and decided summarily under Art. 108(1)(b) BGG. Court costs of CHF 500 were imposed on the appellant; no party compensation was awarded to the respondent, who had not been invited to comment.

Omnilex-Regeste

Art. 42 cpv. 2 LTF; admissibility of a constitutional appeal subject to sufficient reasoning; Art. 108 cpv. 1 lett. b LTF. The appellant must, in a concise and focused manner, confront the reasoning of the challenged decision and indicate which legal norms were allegedly violated; merely repeating factual objections or prior arguments is insufficient. Where the submission does not engage with the decisive cantonal reasoning and fails to substantiate an arbitrary application of cantonal procedural law, the appeal is manifestly inadmissible and may be disposed of in summary procedure. Costs follow the outcome under Art. 66 cpv. 1 LTF; no party compensation is due if the respondent was not called upon to answer.

Sentenza del 3 febbraio 2010
I Corte di diritto civile

Composizione
Giudice federale Klett, Presidente,
Cancelliere Thélin.

Parti

B.________,
opponente.

Oggetto
pretesa contrattuale,

ricorso in materia costituzionale contro la sentenza emanata il 7 dicembre 2009 dalla Camera di cassazione civile del Tribunale d'appello del Cantone Ticino.

Considerando:
che l'avvocato B.________ ha adito il Giudice di pace del circolo di Balerna per ottenere la condanna di A.________ al pagamento di fr. 380.--, oltre interessi del 5 % dal 9 ottobre 2009, pari al prezzo d'una consulenza;
che il 16 novembre 2009 il Giudice di pace ha accolto tale richiesta, essendo provato che la convenuta si è recata nello studio del legale a X.________ e che tra le parti vi è stato un colloquio di un'ora intera, durante il quale almeno un consiglio è stato dato, indi per cui un contratto c'è stato;
che, adita dalla convenuta, il 7 dicembre 2009 la Camera di cassazione civile del Tribunale d'appello del Cantone Ticino ha giudicato il ricorso inammissibile siccome non motivato conformemente ai requisiti posti dall'art. 329 cpv. 2 CPC/TI, essendosi ella limitata a riproporre le sue contestazioni in merito alla pretesa avversaria, senza confrontarsi con le argomentazioni del primo giudice;
che la Camera di cassazione civile si è comunque espressa anche nel merito, a sfavore della convenuta;
che contro questa sentenza la convenuta è insorta dinanzi al Tribunale federale con scritto dell'11 gennaio 2010;
che né l'attore (qui opponente) né l'autorità cantonale sono stati invitati a esprimersi su tale allegato;
che, giusta l'art. 42 cpv. 2 della legge sul Tribunale federale (LTF), chi adisce il Tribunale deve spiegare in modo conciso perché l'atto impugnato viola il diritto;
che la ricorrente non si attiene a questa regola;
che ella si limita a risollevare le sue contestazioni in merito alla pretesa avversaria e a lamentarsi delle difficoltà imposte alla litigante sprovvista di patrocinatore, senza nemmeno tentare di dimostrare un'applicazione arbitraria dell'art. 329 cpv. 2 CPC/TI da parte del Tribunale d'appello;
che il ricorso si avvera pertanto d'acchito inammissibile per carente motivazione;
che in simili circostanze si può decidere di non entrare nel merito del gravame mediante la procedura semplificata dell'art. 108 cpv. 1 lett. b LTF;
che le spese giudiziarie sono addossate alla ricorrente in conformità con l'art. 66 cpv. 1 LTF;
che all'opponente non spetta nessuna indennità per ripetibili della sede federale, non essendo egli nemmeno stato invitato a determinarsi;

per questi motivi, la Presidente pronuncia:

1.
Il ricorso è inammissibile.

2.
Le spese giudiziarie di fr. 500.-- sono poste a carico della ricorrente.

3.
Comunicazione alle parti e alla Camera di cassazione civile del Tribunale d'appello del Cantone Ticino.

Von Omnilex extrahiert

Kernrechtsfrage

Whether the constitutional appeal complied with the duty to reason under Art. 42(2) BGG.

Extrahierter Entscheid

No. The appellant merely repeated her factual objections and complaints without showing how the cantonal decision violated federal law or why the application of Art. 329(2) CPC/TI was arbitrary.

Extrahierte Begründung

A federal appeal must concisely explain the alleged legal error. Because the submission did not engage with the cantonal court's reasoning, it was manifestly inadmissible for lack of reasoning and could be disposed of summarily under Art. 108(1)(b) BGG.

Kernrechtsfrage

Allocation of federal court costs

Extrahierter Entscheid

The appellant bears the court costs of CHF 500.

Extrahierte Begründung

Costs follow the outcome under Art. 66(1) BGG. The respondent was not invited to comment and therefore receives no compensation.
