A.X. and B.X. filed a subsidiary constitutional complaint in a dispute over an entrepreneur’s remuneration. After their application for legal aid had been rejected and they had been ordered to pay an advance on costs, their counsel withdrew the appeal. The Federal Supreme Court took note of the withdrawal, removed the case from the docket, and ordered the appellants to pay a judicial fee of CHF 500 jointly and severally.
Art. 32 al. 2 LTF; withdrawal of the appeal and removal from the docket. When the appellant withdraws the appeal, the Federal Supreme Court takes note of the withdrawal and strikes the case off the roll. Costs are allocated according to Art. 66 al. 2, 3 and 5 LTF; in the absence of a continuation of the proceedings, a judicial fee may be imposed on the appellants, including jointly and severally where appropriate.

Vu l'ordonnance présidentielle du 19 juin 2009 invitant les recourantes à verser une avance de frais de 1'500 fr. jusqu'au 6 juillet 2009;
Vu la lettre du 6 juillet 2009 par laquelle le mandataire des recourantes a retiré le recours au nom de celles-ci;
Considérant qu'il y a lieu de prendre acte de ce retrait et de rayer la cause du rôle (art. 32 al. 2 LTF);
Vu, quant aux frais, l'art. 66 al. 2, 3 et 5 LTF,
Ordonne:

Il est pris acte du retrait du recours.
2.
La cause 4D_37/2009 est rayée du rôle.
3.
Un émolument judiciaire de 500 fr. est mis à la charge des recourantes, solidairement entre elles.

La présente ordonnance est communiquée aux mandataires des parties et à la Cour civile du Tribunal cantonal du canton du Jura.

Whether the withdrawn constitutional complaint should be taken note of and removed from the docket.
The Court took note of the withdrawal and ordered the case removed from the docket.
Once the appellants' counsel withdrew the appeal, there was no reason to continue; the Court therefore struck the matter off the roll under Art. 32(2) LTF.
Who bears the court fee after the withdrawal of the appeal.
A judicial fee of CHF 500 was imposed on the appellants jointly and severally.
Costs were allocated pursuant to Art. 66(2), (3) and (5) LTF.
