Omnilex-Zusammenfassung

In a construction contract case, the plaintiff appealed a Zurich Commercial Court judgment to the Federal Supreme Court. While the federal appeal was pending, the Zurich Cassation Court upheld the cantonal nullity complaint, set aside the Commercial Court judgment, and remitted the matter for reconsideration. Because that cantonal decision was not challenged within the federal time limit, the appealed judgment no longer stood, so the Federal Supreme Court declared the appeal moot and removed it from the docket. The court fee of CHF 500 was charged to the appellant.

Omnilex-Regeste

Art. 100 Abs. 1 BGG; Art. 132 Abs. 1 BGG; Art. 156 Abs. 6 OG: if, during the pendency of a federal appeal governed by the former OG, the cantonal judgment attacked before the Federal Supreme Court is annulled by the cantonal cassation authority and that annulment is not itself challenged within the federal time limit, the appeal becomes moot and is struck off the docket. Mootness leads to allocation of the court fee against the appellant under Art. 156 Abs. 6 OG.

Gegenstand
Werkvertrag,

Januar 2006.

Das Bundesgericht zieht in Erwägung:
Das Bundesgesetz über das Bundesgericht vom 17. Juni 2005 (BGG; SR 173.110) ist am 1. Januar 2007 in Kraft getreten (AS 2006 1205, 1243).

Kernrechtsfrage

Whether the federal appeal should be dismissed as moot after the cantonal cassation court set aside the challenged judgment.

Extrahierter Entscheid

Yes. Because the challenged commercial court judgment had already been annulled and remitted by the cantonal cassation court, the federal appeal had become moot and had to be struck off the list.

Extrahierte Begründung

The cantonal cassation decision was not itself challenged before the Federal Supreme Court within the statutory time limit, so the appealed judgment no longer existed as an operative decision.

Kernrechtsfrage

Who bears the court fee after the appeal became moot.

Extrahierter Entscheid

The appellant bears the court fee.

Extrahierte Begründung

Since the appeal was rendered moot through the procedural outcome, the court allocated the fee to the appellant under the applicable procedural rule.
