The defendants appealed a Zug cantonal judgment in a dispute concerning shareholder/founder liability. They simultaneously filed a constitutional complaint, which the Federal Supreme Court granted on the same day, thereby annulling the challenged judgment. The appeal therefore lost its object and was struck out as moot. The Court held that, where one of two parallel remedies becomes moot in this way, the party who filed the remedy bears the resulting costs and compensation. Accordingly, the defendants were ordered to pay the CHF 1,000 court fee jointly and severally and to compensate the plaintiff with CHF 7,000.

Where a party files two remedies in the same matter and one of them is granted so that the challenged decision is annulled, the other remedy becomes devoid of object and is removed from the docket (consid. 1). In such a constellation, the costs and party compensation are allocated against the party who initiated the remedy giving rise to the procedural consequence; joint and several liability may be ordered for both court fees and party indemnity (consid. 2).

dass damit das vorliegende Berufungsverfahren gegenstandslos geworden ist, weshalb es abzuschreiben ist;
dass bei Gegenstandslosigkeit des einen von zwei in der gleichen Sache eingelegten Rechtsmittels derjenige kosten- und entschädigungspflichtig wird, der das Rechtsmittel ergriffen hat;
weshalb ausgangsgemäss die Kosten den Beklagten unter solidarischer Haftbarkeit aufzuerlegen und diese zu verpflichten sind, die Klägerin für das bundesgerichtliche Berufungsverfahren zu entschädigen;
beschliesst das Bundesgericht:

Das Verfahren wird infolge Gegenstandslosigkeit erledigt abgeschrieben.
2.
Die Gerichtsgebühr von Fr. 1'000.-- wird den Beklagten unter solidarischer Haftbarkeit auferlegt.
3.
Die Beklagten haben die Klägerin für das bundesgerichtliche Verfahren unter solidarischer Haftbarkeit mit ingesamt Fr. 7'000.-- zu entschädigen

Dieser Beschluss wird den Parteien und dem Obergericht des Kantons Zug, Zivilrechtliche Abteilung, schriftlich mitgeteilt.

Whether the civil appeal remained justiciable after the parallel constitutional complaint was upheld and the challenged judgment was annulled.
The appeal had become moot and was therefore removed from the docket.
Because the parallel constitutional complaint was granted, the challenged cantonal judgment was set aside; as a result, the appeal no longer had an object and had to be struck out as moot.
