X.________ SA filed an appeal in an international arbitration matter against an ICC arbitral award. During the federal proceedings, the parties settled their dispute, and the appellant withdrew the appeal. The Federal Supreme Court took formal note of the withdrawal, removed the case from the docket, and held that the earlier provisional stay of enforcement became moot by operation of law. It fixed the judicial fee at CHF 20,000, to be borne equally by the parties, and declined to award party costs to the respondent.

The withdrawal renders any prior provisional or definitive suspension of the proceedings devoid of purpose and thus caducous ipso jure. Court costs are allocated in light of the agreement of the parties and the general rule on costs in withdrawal cases; the amount of the judicial fee may also reflect the value in dispute under Art. 65 al. 2 LTF. If the respondent waives party costs, none are awarded under Art. 66 al. 2 LTF.

Vu le recours en matière civile, au sens de l'art. 77 LTF et des art. 190 ss LDIP, formé par X.________ SA contre la sentence finale rendue le 9 août 2010 par un Tribunal arbitral de trois membres, statuant sous l'égide de la Chambre de Commerce Internationale (CCI), dans la cause opposant la recourante à la Société Y.________, intimée;
Vu les ordonnances présidentielles des 30 septembre et 9 novembre 2010 accordant l'effet suspensif au recours à titre provisoire, puis jusqu'au terme de la procédure fédérale;
Vu l'ordonnance du 4 avril 2011 par laquelle la Présidente de la Ire Cour de droit civil, accédant à une requête commune des parties, a dit qu'il serait sursis à statuer jusqu'au 27 mai 2011;
Vu les lettres présidentielles des 23 mai et 16 juin 2011 prolongeant ce délai une première fois jusqu'au 15 juin 2011, puis une seconde fois jusqu'au 31 juillet 2011, à la demande des parties;
Vu la lettre du 28 juillet 2011 par laquelle les conseils des parties informent le Tribunal fédéral qu'en vertu d'un accord transactionnel trouvé par celles-ci pour mettre fin au litige qui les oppose, X.________ SA retire son recours;
Considérant qu'il y a lieu de prendre acte de ce retrait et de rayer la cause 4A_500/2010 du rôle, ce qui rend caduque, ipso jure, l'ordonnance du 9 novembre 2010, précitée, octroyant l'effet suspensif au recours;
Attendu que, selon les indications fournies dans la susdite lettre, les parties sont convenues de supporter par égales parts les frais judiciaires afférents à la procédure fédérale, l'intimée renonçant à l'allocation de dépens,
qu'il convient, en conséquence, de mettre l'émolument judiciaire pour moitié à la charge de chacune des parties et de ne point allouer de dépens à l'intimée,
qu'il y a lieu de tenir compte, pour fixer le montant de l'émolument judiciaire, de la valeur litigieuse considérable de la présente affaire (art. 65 al. 2 LTF), mais aussi du fait que la cause est liquidée par un désistement (art. 66 al. 2 LTF);
Vu l'art. 32 al. 2 LTF,
Ordonne:
1.
Il est pris acte du retrait du recours.
2.
La cause 4A_500/2010 est rayée du rôle.
3.
Un émolument judiciaire de 20'000 fr. est mis pour moitié à la charge de chacune des parties.
4.
Il n'est pas alloué de dépens.
5.
La présente ordonnance est communiquée aux mandataires des parties et au président du Tribunal arbitral CCI.

The court took note of the withdrawal and struck the case from the docket.
A settlement ended the dispute, and the appellant formally withdrew the appeal; the pending proceedings therefore became moot and had to be removed from the roll.
Allocation of federal court costs and costs consequences after withdrawal.
The judicial fee was set at CHF 20,000 and borne half by each party; no party costs were awarded.
The parties agreed to share the court costs equally, and the respondent waived party costs. The court also took into account the high value in dispute and the fact that the case ended by withdrawal.
