Kernrechtsfrage
Whether a request for exequatur under the Lugano Convention requires a separate legal interest when no enforcement measures are requested simultaneously.
Extrahierter Entscheid
A legal interest exists for exequatur even if the applicant does not concurrently seek enforcement measures; the cantonal court imposed an extra requirement not found in the Convention.
Extrahierte Begründung
Articles 31 ff. aLugÜ allow an independent exequatur procedure. The applicant may choose whether to combine it with enforcement measures under Art. 39(2) aLugÜ. Recognition already confers the status of an enforceable domestic title, so the mere absence of immediate enforcement requests does not defeat standing.
