Garage X________ filed a federal appeal in an employment wage dispute against a cantonal cassation judgment. Before the Federal Supreme Court ruled on the merits, the appellant withdrew the appeal by letter of 26 June 2009. The First Civil Law Court therefore ordered the case removed from the docket and charged judicial costs of CHF 300 to the appellant.
Art. 32 al. 2 LTF; withdrawal of appeal and removal from the docket. When the appellant expressly withdraws the appeal, the Federal Supreme Court strikes the matter from the docket without examining the merits. The withdrawal terminates the proceedings and entails the allocation of court costs to the withdrawing party, unless special circumstances justify a different allocation.

Whether the federal appeal should be removed from the docket after withdrawal
The case was struck from the docket because the appeal had been withdrawn.
The appellant expressly declared withdrawal of the appeal; under Art. 32(2) LTF the matter was therefore removed from the docket.
Allocation of federal court costs after withdrawal of the appeal
Judicial costs of CHF 300 were charged to the appellant.
Because the withdrawal led to termination of the proceedings, the court ordered the costs against the appellant.
