The Swiss Federal Court did not enter into a constitutional complaint against a cantonal disciplinary decision involving two lawyers. The complainant had challenged only the costs and compensation order, but her arguments essentially attacked the merits of the discontinued disciplinary proceedings. The Court held that she lacked standing to contest the substance of the disciplinary decision, could not rely on a hearing-right violation as a non-party, and could not invoke Articles 6 or 13 ECHR. The complaint was therefore summarily rejected under the simplified procedure, and the complainant was ordered to pay the federal court fee of CHF 1,000.

A person not affected in legally protected interests and without party status in the cantonal proceedings is not entitled to contest the merits of a disciplinary decision, nor may she indirectly obtain merits review by challenging the cost order alone. Admissible objections against the cost order are limited to issues independent of the merits, such as absence of legal basis, inconsistency with the outcome, or excessiveness of fees/indemnities (consid. 2). Such a complainant cannot invoke violation of the right to be heard, and disciplinary disputes of this type, as well as disputes confined to procedural costs, do not fall under Art. 6 Ziff. 1 EMRK; Art. 13 EMRK likewise does not apply (consid. 3).
