Omnilex-Zusammenfassung

The appellant challenged the refusal to renew his study residence permit by filing a so-called revision request, treated as a subsidiary constitutional complaint. The Federal Supreme Court invited him to submit the challenged cantonal decision or to file an appeal before the cantonal administrative court. The invitation was sent by registered mail and returned unclaimed after the holding period. The court held that service was valid under the Federal Supreme Court Act and that the appellant could not rely on his absence because he had not arranged for forwarding or notified it. As the challenged decision was not produced within the deadline, the complaint was manifestly inadmissible. A judicial fee of CHF 200 was imposed on the appellant.

Omnilex-Regeste

Art. 44 al. 2 et 108 LTF; notification by registered mail and failure to produce the challenged decision in subsidary constitutional complaint proceedings. A communication sent to the address indicated by a party is deemed duly served when it remains unclaimed after the postal holding period, provided the addressee could reasonably expect a procedural communication and failed to take the necessary forwarding arrangements or to notify an absence. If the party does not comply with an order to file the challenged decision within the set time limit, the constitutional complaint is manifestly inadmissible and may be disposed of in simplified proceedings under art. 108 LTF; costs follow the outcome under art. 65 and 66 LTF.

Arrêt du 18 septembre 2007
IIe Cour de droit public

Composition
M. le Juge Merkli, Président.
Greffière: Mme Charif Feller.

Parties
X.________, recourant,

contre

Kernrechtsfrage

Whether the subsidary constitutional complaint was admissible without production of the challenged decision.

Extrahierter Entscheid

No. The invitation to file the decision was validly served, the deadline expired without compliance, and the complaint was therefore manifestly inadmissible.

Extrahierte Begründung

The court applied the rules on service and deemed the postal notice received after the failed delivery attempt. As the appellant had not arranged for mail forwarding and had not announced his absence, he could not rely on non-receipt.

Kernrechtsfrage

Who must bear the court costs.

Extrahierter Entscheid

The unsuccessful appellant must pay a judicial fee of CHF 200.

Extrahierte Begründung

Costs follow the outcome under the Federal Supreme Court Act.
