Inadmissibility of appeal against refusal of student residence permit

Omnilex-Zusammenfassung

A Cameroonian national challenged the Geneva authorities' refusal to renew his student residence permit. The Federal Supreme Court held that he had no statutory or treaty-based entitlement to the permit, so an appeal in public law matters was excluded. Treated as a subsidiary constitutional complaint, the filing remained inadmissible because proportionality does not confer an autonomous constitutional claim and the arbitrariness argument was insufficiently reasoned; in any event, he lacked standing without a protected legal interest. The appeal was dismissed as inadmissible and CHF 600 in court costs were imposed on the appellant.

Omnilex-Regeste

Art. 83 let. c ch. 2 LTF; art. 115 let. b LTF; art. 108 LTF: absence of a legally protected entitlement to a residence permit for studies excludes the ordinary public-law appeal and, in principle, limits the party to a subsidiary constitutional complaint. Proportionality under art. 5 al. 2 Cst. is not an autonomous constitutional right. A complaint of arbitrariness under art. 9 Cst. is admissible only if the complainant has standing by virtue of a protected legal interest; without such entitlement, the grievance is not open. A manifestly inadmissible filing may be dealt with in simplified proceedings without exchange of submissions (consid. 1).

Arrêt 15 septembre 2008
IIe Cour de droit public

Composition
M. le Juge Merkli, Président.
Greffière: Mme Charif Feller.

Parties
X.________, recourant,

contre

115 let. b LTF; cf. ATF 133 I 185 consid. 6.1 p. 197 s.),

Kernrechtsfrage

Whether the appeal against refusal of a student residence permit was admissible in public law matters.

Extrahierter Entscheid

No. The applicant could not rely on a federal or international provision granting a right to the permit, so public law appeal was unavailable.

Extrahierte Begründung

Without a legally protected entitlement to the residence permit, the decision fell under the exclusion of Art. 83 let. c ch. 2 LTF; only a subsidiary constitutional complaint was possible.

Kernrechtsfrage

Whether the subsidiary constitutional complaint could be used to invoke proportionality or arbitrariness.

Extrahierter Entscheid

Proportionality, although constitutional, is not a constitutional right with independent standing; an arbitrariness complaint was not sufficiently reasoned and in any event the applicant lacked standing without an entitlement to the permit.

Extrahierte Begründung

The court held that Art. 115 let. b LTF requires a legally protected interest. Because no entitlement to a student permit existed, the applicant could not complain of arbitrariness.

Kernrechtsfrage

Allocation of court costs after dismissal as inadmissible.

Extrahierter Entscheid

The applicant had to bear the judicial costs of CHF 600.

Extrahierte Begründung

As the losing party, he was ordered to pay costs under the Federal Supreme Court Act.
