Omnilex-Zusammenfassung

The Federal Tribunal dealt with a complaint against cantonal detention pending removal. The appellant submitted only a brief letter requesting justice and a B permit, without explaining why the cantonal judgment was unlawful. The court held that the filing plainly failed the motivation requirements of Art. 42 LTF and was therefore manifestly inadmissible under Art. 108 al. 1 let. b LTF. It added in passing that the detention would in any event be supportable because of the appellant's change of name. No court fee was charged.

Omnilex-Regeste

Art. 42 al. 1-2 LTF, Art. 108 al. 1 let. b LTF; inadmissibility of an appeal for insufficient reasoning. A submission must, in an official language, contain conclusions and grounds and set out succinctly in what respect the challenged decision violates law; a mere request for justice or unrelated claims does not satisfy the motivation requirement. Where this requirement is manifestly not met, the Federal Tribunal may decide summarily under Art. 108 LTF without exchange of written submissions. In such a case, the court may dispense with costs under Art. 66 al. 1 LTF in view of the circumstances (consid. 4-5).

Arrêt du 4 octobre 2011

recourant,

Whether the appeal complied with the Federal Tribunal's formal motivation requirements.

Extrahierter Entscheid

The filing did not explain how the cantonal judgment violated federal law and therefore failed to meet the requirements of Art. 42 LTF.

Extrahierte Begründung

A brief letter asking for justice and a residence permit, without addressing the reasoning of the challenged decision, is manifestly insufficiently reasoned.

Kernrechtsfrage

Whether the detention pending removal should be disturbed on the merits.

Extrahierter Entscheid

No substantive review was needed because the appeal was inadmissible; the court noted in any event that the detention would be justified by the change of name.

Extrahierte Begründung

The court only made an obiter remark that the conduct indicated unwillingness to comply with authorities and could support detention under Art. 76 al. 1 let. b ch. 4 LEtr.
