Kernrechtsfrage
Whether the public law appeal against the cantonal judgment was admissible in a foreign nationals permit case.
Extrahierter Entscheid
The appeal was inadmissible because no federal or international provision conferred a right to the requested permit.
Extrahierte Begründung
Art. 83(c)(2) LTF bars public law appeals against foreign nationals decisions on permits where no right exists. The applicant could not derive a claim from Swiss federal law, any bilateral treaty, Article 8 ECHR, the aliens ordinance, or the Free Movement Agreement; the latter did not yet apply to Romania, and no derived right could be based on his Italian spouse living in Italy.
