Inadmissibility for lack of constitutional reasoning in reconsidération appeal

Omnilex-Zusammenfassung

X. appealed to the Federal Supreme Court against a Geneva judgment rejecting, as far as admissible, his request for reconsideration concerning a residence permit matter. The Court held that the appellant failed to raise and substantiate any constitutional grievance, in particular arbitrariness, against the cantonal court’s application of cantonal procedural law. Because the appeal did not meet the requirements of Art. 106(2) LTF, it was manifestly inadmissible under Art. 108(1)(b) LTF and decided in simplified procedure without written submissions. Court costs of CHF 500 were imposed on the appellant.

Omnilex-Regeste

Art. 106 al. 2, 108 al. 1 let. b, 66 al. 1 LTF; cantonal law review in federal proceedings and requirements of motivation: a complaint directed only against the application of cantonal procedural law is inadmissible unless the appellant specifically alleges and substantiates a constitutional violation, in particular arbitrariness under Art. 9 Cst. The mere assertion that the cantonal decision is unjust or overly harsh is insufficient. If no cognizable constitutional grievance is raised, the appeal is manifestly inadmissible and may be disposed of in the simplified procedure under Art. 108 LTF; the losing party bears the costs (consid. 3-4).

Arrêt du 24 juin 2011
IIe Cour de droit public

Composition
M. le Juge Zünd, Président.
Greffier: M. Dubey.

Participants à la procédure
X.________, recourant,

contre

106 al. 2 LTF, ATF 136 I 65 consid. 1.3.1 p. 68).
