Omnilex-Zusammenfassung

The taxpayer challenged a cantonal judgment confirming cantonal and communal tax on an immovable gain of CHF 691,498. In a short federal filing, he asserted that his reinvestment request had been timely and that he would later file bank records proving the investment and source of funds. The Federal Court held that the submission did not meet the reasoning requirements of Art. 42 LTF and that the proposed bank documents were new evidence barred by Art. 99 LTF. The appeal was therefore manifestly inadmissible under Art. 108 LTF, without written exchange, and court costs of CHF 800 were imposed on the appellant.

Omnilex-Regeste

Art. 42 al. 1 and 3 LTF, Art. 99 LTF; federal appeal requirements and inadmissibility of new evidence: an appeal must, in an official language, contain conclusions, reasons and offered evidence, and must engage with the challenged judgment's reasoning. Mere announcements of future proof or assertions not directed against the lower court's grounds do not satisfy the duty to reason. Evidence not already in the record and not resulting from the decision below is inadmissible before the Federal Court. A manifestly insufficiently reasoned appeal is dealt with under Art. 108 LTF and declared inadmissible (consid. 3-4). Costs are borne by the losing party under Art. 66 al. 1 LTF.

Arrêt du 22 mai 2013

Administration fiscale cantonale genevoise.

Objet

Kernrechtsfrage

Whether the federal appeal was sufficiently reasoned and admissible.

Extrahierter Entscheid

No. The filing did not challenge the cantonal judgment's reasoning or show arbitrariness in the assessment of evidence.

Extrahierte Begründung

Under Art. 42 LTF, the appeal must state reasons and evidence; the appellant merely announced later bank documents and did not engage with the lower court's detailed findings. New evidence was inadmissible under Art. 99 LTF.

Kernrechtsfrage

Whether the appellant could rely on later-produced bank documents to support the reinvestment claim.

Extrahierter Entscheid

No. The documents were new and therefore could not be considered.

Extrahierte Begründung

Evidence not already in the file and not resulting from the prior decision is inadmissible before the Federal Court.

Kernrechtsfrage

Allocation of federal court costs.

Extrahierter Entscheid

The appellant had to bear the costs because he failed in the proceedings.

Extrahierte Begründung

Costs follow the losing party under Art. 66(1) LTF.
