Art. 43 KG grants third parties participation rights only in an investigation, not in a preliminary inquiry. By virtue of Art. 39 KG, special cartellaw rules prevail over the VwVG. Without party status, the appellant could not demand an appealable decision, nor raise denial of justice or hearing violations at that stage.
