Omnilex-Zusammenfassung

The Federal Supreme Court declared a public-law appeal inadmissible because the appellant’s submission was abusive: it contained irrelevant arguments, insulting remarks toward the judicial authorities, and no serious engagement with the reasons of the cantonal decision. The Court relied on Art. 36a OJ and recalled that the appellant had already been warned by earlier federal judgments. Court costs of CHF 500 were imposed on the appellant.

Omnilex-Regeste

Art. 36a OJ; abusively drafted appeal and failure to address the challenged decision’s reasoning render a public-law appeal non-enterable. A filing is abusive where it contains irrelevant material, insulting allegations against judicial authorities, and no meaningful discussion of the operative grounds of the attacked judgment. In such a case the Federal Supreme Court may refuse to enter into the matter without examining the merits; repeated similar filings may be summarily dealt with, and the costs are borne by the appellant (consid. 1).

Nay, Reeb,
greffier Thélin.

A.________, recourant,

contre

Que l'acte de recours contient de longs développements sans rapport avec l'objet de l'arrêt attaqué;
Qu'il contient également des accusations injurieuses à l'égard des autorités judiciaires;
Que pour le surplus, le recourant se borne à développer ses propres opinions sur l'affaire en cause, sans tenter de réellement discuter les motifs de l'arrêt attaqué;
Que cette façon de procéder est abusive au sens de l'art. 36a al. 2 de la loi fédérale d'organisation judiciaire, de sorte que le Tribunal fédéral n'entre pas en matière;
Que le recourant en a d'ailleurs déjà averti par de précédents arrêts du Tribunal fédéral (arrêt 1P.765/2001 du 10 décembre 2001 et 1P.787/2001 du 10 janvier 2002);
