Kernrechtsfrage
Admissibility of the public-law appeal against an incidental refusal of legal aid
Extrahierter Entscheid
The appeal was admissible in principle because the refusal of legal aid is an incidental decision that can cause irreparable legal harm, but the request for more than annulment was inadmissible.
Extrahierte Begründung
Under Art. 87 OG, incidental decisions may be challenged if they cause irreparable harm. A denial of legal aid has that effect. However, the constitutional appeal is generally cassatory only.
