1F_22/2008 ΓÇó Revision request dismissed as inadmissible
1F_22/2008Bundesgericht / I. öffentlich-rechtliche Abteilung11.11.2008Dismissed
X. requested revision of two earlier Federal Supreme Court judgments arising from a traffic-law matter. The Court held that the revision request against the judgment of 13 August 2008 was filed out of time. As to the judgment of 21 October 2008, the applicant did not identify any revision ground; mere disagreement with the legal reasoning is insufficient in revision proceedings. The Court therefore did not enter on the request without exchange of written submissions and waived court costs.
Art. 121 ff. BGG, Art. 127 BGG; revision of a final Federal Supreme Court judgment is admissible only on a statutory ground and within the applicable time limit. A request that merely attacks the legal assessment of the earlier judgment is not a revision ground and is not heard in revision proceedings. If no revision ground is set out, the Court may decline to enter on the request without exchange of submissions. Under Art. 66 Abs. 1 BGG, costs may exceptionally be waived.
